Attorney General Lisa Madigan’s office has filed an emergency appeal with the Illinois Supreme Court to settle conflicting court orders about whether state employees can be paid during the budget impasse.

Last week a Cook County judge said only some covered by federal minimum wage law could get paid, but the action was put on hold. A St. Clair County judge later ruled state workers can receive their entire paychecks.

The appeal filed Monday asks the high court to directly consider the matter. Madigan’s office also took steps in the county cases.

Comptroller Leslie Munger says her office has completed processing paychecks due Wednesday. About 6,800 employees will be paid on time.

The Democrat-controlled Legislature and Republican Gov. Bruce Rauner have yet to agree on a budget for the current fiscal year.
