MARION, Ill. (AP) — A southern Illinois police officer who planned to keep his job despite winning election to the Marion City Council is taking a paid leave of absence until city officials can determine if he can keep both positions.

Before his election, Sgt. Angelo Hightower had filed a racial discrimination complaint against the city after he was denied a promotion to lieutenant. He was sworn into office Monday night.

The Associated Press reports Hightower was initially told at the swearing-in ceremony that he would have to resign.

Marion officials have cited an Illinois law that prohibits city officials from serving in multiple offices within the same government, as well as appellate court rulings.

The city has filed for a declaratory judgment in Williamson County. Hightower has 30 days to respond.
