Police Chief Lawsuit Dismissed

A lawsuit against the police chief in Johnston City for deprivation of rights, deliberate indifference to serious medical needs and battery has been dismissed.

The lawsuit was filed in October of this year for an incident in October of last year. Kimberly West of Herrin says she punched in the face by Campbell while handcuffed in the back of a police car and she wasn't read her Miranda Rights.

The judge dismissed the charges because West failed to state a proper claim and because the court does have jurisdiction for battery charges.

West has until Dec. 4 to appeal.
