Suspect Wants Statements Thrown Out

In Franklin County, a murder suspect wants statements he made to police the night of the crime to be thrown out.
Motions filed by attorneys for 39-year-old Donald Lee were addressed Tuesday in court. Police say Lee was agitated and aggressive when they first questioned him after the shooting death of 23-year-old Brittany Andrews on May 17, but then passed out and needed medical attention. Police say he appeared drunk and sobered up during the questioning.
Lee’s attorney says he did not know or waive his Miranda Rights, and the interrogation should have stopped after Lee told police to get him a lawyer. The State’s Attorney says Lee continued to speak willingly.
A judge says he will rule on the motion as soon as possible. Lee’s final pre-trial conference is Thursday, and his trial is set for October 8th.
