New Open Area Law

Those who open their land for conservation and recreation have greater legal protection thanks to a new law.

The law limits liability for landowners who allow the public access to their property for activities such as biking, hiking, and fishing. Those protections were restricted by the state seven years ago. State Sen. Don Harmon (D-Oak Park), one of the bill’s sponsors, says that forced landowners to cut off access.

“On the one hand, we want to make sure that anyone who’s injured has the opportunity to be compensated for their injuries,” Harmon said, “but not at the expense of shutting off open land.”

Currently, liability protections exist only for hunters, which will remain under the new law.
