New Murder Trial



In Jackson County, a man could face trial for murder again after the state Supreme Court rules his right to a speedy trial was not violated.
 
A 5-2 vote from the Court could send Elijah Lacy back to Jackson County Court. He is accused of shooting and killing Falon Taylor in January 2007 during a home invasion in Carbondale. 
 
Officials requested three 30-day extensions to the start of the trial, which Lacy’s attorney said was too many. The charges were thrown out in July 2010 after a motion to dismiss based on the claim that Lacy’s right to a speedy trial was violated.
 
An appellate court upheld the dismissal in 2011 and the Illinois Supreme Court allowed the state to appeal in January 2012.
 
In its decision, the Illinois Supreme Court says multiple 60-day extensions are fine as long as they’re for different reasons. Lacy’s attorney says the judges found a loophole in the law that doesn’t actually exist.
