In Franklin County, a judge says the statements made to police by the mother accused of killing her daughter and hiding the body in her basement are O.K. to use as evidence.
An attorney for 30-year-old Mary Zumwalt-Jophlin says the conflicting statements made to police regarding the death of her child were caused by interrogators using illegal and aggressive tactics, but the judge denied a motion to suppress those statements Thursday in court.
Zumwalt-Jophlin faces charges of murder, concealment of a homicidal death and obstruction of justice in the death of her then-8-year-old daughter Alexus Nicole Smothers on July 19, 2011.
A pretrial conference is set for August 8th and the judge says he wants a trial date set by then.
